Identifying these functions is a requirement of the Americans with Disabilities Act (as amended) and is critical to the search for qualified job applicants. The following considerations in and basis for identification of <em>essential<\/em> <em>functions<\/em> are by no means exhaustive. The institution\u2019s HR office or attorney should be consulted for further guidance.<\/p>\n<p>Some considerations in identifying essential functions are:<\/p>\n<ul>\n<li>Whether functions are limited in number;<\/li>\n<li>The frequency or regularity with which they are performed;<\/li>\n<li>Whether the former incumbent actually performed the functions;<\/li>\n<li>Whether the new individual in the position will be expected to perform the functions;<\/li>\n<li>Whether removing any of the functions would change the job.<\/li>\n<\/ul>\n<p>A function is essential if<\/p>\n<ul>\n<li>The position exists to perform it;<\/li>\n<li>The number of other employees available to perform it is limited;<\/li>\n<li>The person performing the function is hired for his or her ability to perform it.<\/li>\n<\/ul>\n<p>Essential functions are identified on the basis of<\/p>\n<ul>\n<li>Employer\u2019s judgment;<\/li>\n<li>Job description;<\/li>\n<li>Position announcements and advertisements;<\/li>\n<li>Proportion of time spent performing the function;<\/li>\n<li>Work experience of incumbents and individuals in similar positions;<\/li>\n<li>The nature of the job.<\/li>\n<\/ul>\n<p>Beyond meeting the requirements of the law, identifying <em>essential functions<\/em> helps hiring managers gain a greater degree of clarity about what the position requires.
